TWO YEAR LIMITED WARRANTY ON MATERIALS & WORKMANSHIP AND FOUR YEAR LIMITED WARRANTY ON UV DEGRADATION

INLAND TARP & LINER, INC. (IT&L), warrants the products defined below to the original owner of the defined products that said products are free of defects in the materials and workmanship, provided the product is purchased from IT&L or an authorized dealer.  Limited warranty coverage for IT&L’s listed products herein is for two years on material & workmanship and three years on degradation by ultra violet light from the purchase date.  This Limited Warranty is non transferable and shall apply only to normal and ordinary use of the product, subject to all limitations described below.  This warranty dated September 15, 2009 supersedes all previous warranties.

Claims under the Limited Warranty must be made to IT&L or an authorized dealer within four years of purchase.  Proof of purchase is required.

This Limited Warranty does not apply to damage or failure due to accident, abuse, neglect, normal wear and tear, improper assembly or maintenance, or installation of parts or accessories not originally intended or incompatible with the product as sold.

Products covered by the Limited Warranty are as follows:

New Performer Hay Tarps
(Note:  Used Tarps are sold as-is with no warranty implied or expressed.)

First and Second Year:  Should the Performer Hay Tarp have a manufacturing defect and/or failure due to UV degradation within the first and second years of purchase by customer from IT&L or its authorized dealer, the defect(s) will, at the option of IT&L, be repaired or replaced at no cost to the customer except for delivery by the customer to IT&L.

Third Year:  Should the Performer Hay Tarp have a failure due to UV degradation within the third year of purchase by customer from IT&L or its authorized dealer, the defect(s) will, at the option of IT&L, be repaired or replaced for a customer charge of 50% of repair or replacement cost plus the cost of delivery by the customer to IT&L.

Fourth Year:  Should the Performer Hay Tarp have a failure due to UV degradation within the third year of purchase by customer from IT&L or its authorized dealer, the defect(s) will, at the option of IT&L, be repaired or replaced for a customer charge of 75% of repair or replacement cost plus the cost of delivery by the customer to IT&L.

IT&L shall not be responsible for incidental or consequential damage.  The user assumes the risk of any personal injury or damage or other losses under the following conditions:

1).  If the product has not been properly installed according to installation instructions shipped with the product (e.g. wind damage as a result of improper installation)

2).  If the damage is from animal, plant (e.g. falling tree), or human contact (e.g. mishandling).

The Limited Warranty applies only to repair or replacement of the products covered herein.  The choice of repairing or replacing any returned product will be at the discretion of IT&L.  The customer’s responsibility is to immediately call IT&L when a defect is found and inform IT&L of the problem and then to protect the products from further damage.  Failure is defined as ultra violet break down of the tarp to the point that it is no longer waterproof.  IT&L will not be responsible for any damage that is caused by the customer’s neglect or inability to protect the purchased product from wind or other potentially damaging elements.  IT&L will not be responsible for any damage by any of its products to any commodity, personal property, real estate, animal or person.  This warranty is limited solely to repair or replacement.  This is the only warranty authorized.  No other warranties are expressed or implied.

This Limited Warranty gives you specific legal rights and your rights may vary from state to state. IT&L does not authorize or permit anyone else, including its dealers, to make any other warranties, expressed or implied.

A warranty claim must be filed immediately upon discovery of a problem. Please e-mail photos and a description of the problem to warranty@inlandtarp.com.  An Inland Tarp & Liner representative will be in touch with you as quickly as possible (usually within 24 hours) to follow-up and resolve the issue.
